Terms of Service

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@genlayers.com if you suspect unauthorized use of your account.

3. The Service

GenLayers uses artificial intelligence, including third-party AI processing providers, to generate customized thumbnail images based on your provided text (titles, prompts) and, optionally, uploaded reference photos. Generation and editing consume "credits" purchased in advance, as described on our Pricing page and in our Refund Policy.

We do not guarantee that any generated output will be accurate, error-free, or meet your expectations. AI-generated content may occasionally be unpredictable, low-quality, or fail to reflect your prompt precisely.

4. Acceptable Use

By using the Service, you agree that you will not:

1. Upload a photograph of any person other than yourself without that person's explicit, informed consent to use their likeness on GenLayers;
2. Upload or attempt to generate content depicting minors in any inappropriate, sexualized, or exploitative context;
3. Use the Service to create content that is sexually explicit, pornographic, hateful, harassing, defamatory, threatening, or that promotes violence or illegal activity;
4. Use the Service to impersonate any person, brand, or entity in a misleading, defamatory, or harassing manner, including through deepfakes intended to deceive or harm;
5. Use generated content to violate the intellectual property, publicity, or privacy rights of any third party;
6. Attempt to bypass, disable, or interfere with any content filtering, moderation, or security systems used by the Service;
7. Use the Service for any unlawful purpose or in violation of any applicable law.

5. Reporting Misuse of Your Likeness

If you believe your photo or likeness has been uploaded or used on GenLayers without your consent, you (whether or not you are a GenLayers user) may submit a report at genlayers.com/report or by emailing support@genlayers.com. We will investigate reports in good faith and may remove content and/or suspend the responsible account pending or following investigation.

6. Ownership of Generated Content

As between you and GenLayers, you own the generated images created from your prompts and uploads, subject to the following:

• Starter Plan: By purchasing and using the Starter plan, you grant GenLayers a non-exclusive, royalty-free license to display your generated thumbnail(s) in our public gallery/showcase for promotional purposes. You may request removal at any time by contacting support@genlayers.com.
• Creator & Pro Plans: Generations are treated as private and will not be featured in our public showcase without your separate, explicit consent.

You are solely responsible for ensuring you have the necessary rights to any content you upload, and for how you use the generated output, including compliance with YouTube's or any other platform's policies.

7. Commercial Usage License

Paid credit packs include a Commercial Usage License, granting you the right to use generated images for monetized content (e.g., YouTube videos, sponsored content, client projects), subject to your compliance with these Terms — including that the underlying uploaded content (e.g., your face) was used with proper rights/consent.

8. Credits, Payments & Refunds

Credits are purchased on a one-time (non-subscription) basis through our payment processor, Freemius, and are subject to the validity periods described on our Pricing page. Refunds are governed by our separate Refund Policy.

9. Third-Party Services

The Service relies on third-party AI processing providers to generate content, and on Freemius to process payments. We are not responsible for the availability, performance, or errors of these third-party services, though we will make reasonable efforts to maintain a functioning Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENLAYERS AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GENLAYERS IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless GenLayers and its owners from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) content you upload or generate; (c) your violation of any third party's rights, including rights of privacy or publicity.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, without refund of unused credits, at our sole discretion. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.
